Pawfect-Dogcare
General Provisions
A contract is concluded between the dog owner and Pawfect-Dogcare upon registration of the dog by the owner. Pawfect-Dogcare takes your dog into appropriate, species-suitable and professional care for the agreed period. The dog owner agrees to this and accepts the General Terms and Conditions set out herein. The dog owner declares that the dog is their property and that they may freely dispose of it without restriction. During care and training, the dog owner remains the owner within the meaning of Section 833 of the German Civil Code (BGB) (strict liability of animal keepers).
Placing an order constitutes acceptance of these terms. Registration of the dog may be made in person, by telephone or by email. The dog owner must provide all statements and information about their dog completely and truthfully.
In the event that the animal is not collected within 5 days after the agreed end date of the boarding period, the pet sitter is entitled to hand the animal over elsewhere, including free of charge (animal shelter, animal-loving person, etc.). Should the pet sitter incur further costs due to the non-collection of the animal, these costs shall be borne by the animal keeper or owner. The applicable daily rate is payable for each additional day. Pawfect-Dogcare has the authority to decline inquiries and orders of any kind without stating reasons.
The dog owner is obliged to inform Pawfect-Dogcare that their female dog is in heat or will be during the stay. Should the dog owner place a female dog in heat into the boarding facility, or a female dog that comes into heat during the stay, and conceal this from Pawfect-Dogcare, no liability will be assumed for the resulting consequences (mating of the female dog during the boarding period). The resulting costs shall be borne solely by the dog owner.
The customer agrees that the personal data and subject-related data collected will be included in the customer file. This data is used exclusively for professional animal care and is not passed on to third parties. Pawfect-Dogcare reserves the right to take photos or videos during care. The owner of the dog being cared for agrees to the publication of these materials by the boarding facility on the website and other media.
Care Contract / Costs
These terms and conditions apply to contracts for the temporary care of dogs as well as all additional services provided to the customer by Pawfect-Dogcare in connection with the temporary care of the dog. Registration is binding and entails the obligation to pay the fee for the care of the dog. The contract comes into effect upon the signature of the owner on the contract signed by Pawfect-Dogcare.
Bindingly agreed appointments that are not cancelled 48 hours in advance will be invoiced by Pawfect-Dogcare. The total price is payable in advance upon booking of the care service by bank transfer or PayPal. After completion of the care service, any remaining care costs incurred will be invoiced and must be paid either in cash upon collection or within 7 days by bank transfer or PayPal.
Should the agreed care period be cancelled, the following conditions apply:
- For cancellation with a lead time of 30 days or more, the full price (if already paid) will be refunded.
- For cancellation with a lead time of less than 30 days, 50% of the costs are payable.
- For cancellation within 72 hours before the start of care, 100% of the agreed care costs will be charged.
Payment can be made either in cash or by bank transfer. The money may be paid in advance and must be settled at the latest upon collection of the dog. In the event of unforeseen emergencies (e.g. serious illness or the death of the animal), no fee will be charged and the contract expires immediately upon presentation of a veterinary certificate. To secure a reservation, half of the boarding costs must be paid in advance. The day of arrival and the day of departure are charged in full.
For new customers, the dog must spend one trial day at Pawfect-Dogcare.
For trips to the veterinarian, we charge an expense allowance of EUR 20.00 per hour started, plus EUR 1.00/km. Should we visit a veterinarian located further away at the dog owner's request, corresponding travel costs will apply additionally.
The care of dogs is generally possible from the age of 18 weeks and regardless of breed.
Liability
The dog receives its usual food, which must be brought by the dog owner. Likewise, the dog owner must bring a secure collar or harness, the dog tags, and a secure dog leash. The dog owner confirms that liability insurance exists for their dog. Before the dog is accepted, the dog owner is advised that their dog is left at Pawfect-Dogcare at their own risk. This refers expressly to the other dogs present there, as well as to conflicts between the animals and their resulting injuries.
Pawfect-Dogcare is likewise not liable for damage to or loss of items (dog collars, dog leashes, dog blankets, dog tags, etc.) given to the dog. The dog owner is aware that their dog is cared for in a group and that conflicts among the dogs may occur. Pawfect-Dogcare is not liable for injuries to the dog that may arise, among other things, from group keeping or from walks with off-leash running. The risks of group keeping and off-leash running are fully understood and accepted by the dog owner.
The dog owner is aware that their dog may be walked off-leash in the group, including in public and non-public exercise areas. For damage that the dog causes to third parties (dog or person), the dog owner is solely liable. If the dog causes damage (e.g. scratched car interior parts, upholstery, etc.), the dog owner is liable for it.
Pawfect-Dogcare assumes no liability for damage the dog may suffer during this time. The dog owner is obliged to have taken out valid dog owner's liability insurance. The dog owner confirms that their dog has received the following vaccinations within the past year: distemper, hepatitis, leptospirosis, parvovirus and rabies (at least every 3 years). If this is not the case, Pawfect-Dogcare may withdraw from the contract.
In the event of a parasite infestation or a contagious disease of a dog that is not reported immediately and not disclosed before handover into care or participation in training, the owner is liable for the following costs:
a) Actual treatment costs of the other dogs in care at Pawfect-Dogcare that had contact with the dog, regardless of whether an actual infestation or infection is present in these dogs or not, as well as the costs of the owners of these dogs arising solely from the possibility of infection (veterinary examination, cleaning costs of blankets, etc.).
b) Lost income of Pawfect-Dogcare. If there is a suspicion of parasite infestation or illness, care will, if necessary, be closed to avoid further infestation or infection (in particular due to cleaning of the home and car). The same applies to cancellations by customers made on the basis of the suspicion.
c) The dog must be checked for parasites and diseases before being placed in care or starting training, and even the mere suspicion must be reported to Pawfect-Dogcare.
d) The dog owner undertakes to inform Pawfect-Dogcare of all behavioral disorders (those already known at the time of admission as well as disorders arising later). The dog owner undertakes to answer all questions about the dog correctly and comprehensively. Any potential danger, previous misconduct, and in particular damage caused by the dog to others must be disclosed.
e) If a female dog is in heat, all liability and responsibility for an unwanted conception is declined.
f) In the case of medication, Pawfect-Dogcare must be informed precisely, preferably in writing, of the manner in which the medication is to be administered. The medication must be provided by the dog owner. Depending on the effort involved in administering the medication, this will be charged separately.
For personal injury or property damage caused by the dog to the dog sitter, dog trainer, or third parties, the dog owner is liable. The dog owners are aware that Pawfect-Dogcare moves with the dogs entrusted to them, both during care and during training (on-leash and off-leash, in the company of other dogs and other environmental stimuli), in open terrain. Furthermore, the dog owners are aware that the dogs are in mobile dog care, i.e. they are housed both in the car and in the home, supervised and unsupervised.
If the dog being cared for causes damage at Pawfect-Dogcare (e.g. to car parts, in the home, or to other dogs being cared for and their accessories), the dog owner bears the costs. Here too, no proof by Pawfect-Dogcare is required. Should a dog run away contrary to expectations, Pawfect-Dogcare is not liable for any damage to the dog or to third parties. However, Pawfect-Dogcare undertakes to initiate all necessary steps (informing the animal shelter, police, and dog owner).
Should there be a possibility of a dog running away (hunting-driven dogs, etc.), precautionary measures will be taken by individual agreement (GPS tracker, drag leash); the costs are borne by the dog owner. Depending on the extent of the behavior, e.g. if the drag leash must be held in hand at all times, group running will be excluded and the dog may instead receive an individual walk.
Should Pawfect-Dogcare deem veterinary treatment necessary during the care period, the owner already consents now to the dog being given veterinary treatment on behalf of and at the expense of the owner. The resulting costs are borne solely by the dog owner. The dog owner will of course be informed beforehand. In emergencies, Pawfect-Dogcare may also act independently, without consulting the dog owner.
Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without stating any reasons. The withdrawal period is fourteen days from the conclusion of the contract. To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by means of a clear declaration (e.g. a letter sent by post or an email).
Acceptance of the Terms and Conditions
By making any contact with Pawfect-Dogcare, you agree to the Terms and Conditions and to the storage and processing of personal data for the purposes of contact, invoicing, and the exchange of information. No transfer to third parties. You consent to contact being made via internet and mobile communication services (telephone, email, SMS, WhatsApp, and other services), provided that you have given your email address, mobile number, or other details.
We expressly point out that data transmission over the internet (e.g. when communicating by email or messenger) may have security gaps. Complete protection of data against access by third parties is not possible. You have the option at any time to revoke all or individual points of these Terms and Conditions.
Image and Sound Recordings
The customer agrees that photos, videos, and sound recordings taken by Pawfect-Dogcare during training may be used for training purposes and for marketing purposes on the internet or in print media. In part, photos or video recordings are made during training by Pawfect-Dogcare or also by third parties. If you do not wish this, you may object at any time to the use of your data for advertising purposes. Otherwise, these recordings are released for any use.
Errors and Mistakes Excepted
All offers are subject to change. Errors and mistakes excepted. Any changes, additions, or the partial or complete cancellation of the contract must be made in writing, including the amendment or cancellation of the written form requirement. Should individual provisions of these Terms and Conditions be void or invalid, this does not affect the validity of the remaining provisions.
